Individual fan activities involving derivative works are generally free, as long as it is within the bounds of common sense.
However, please observe the following conditions.

Prohibited acts

• Any content that damages the image of HypnosisSoft

• Content that infringes or may infringe the rights of others

• Any content that may lead to the misunderstanding that it is official HypnosisSoft content

• Using or publishing game materials other than screenshots and gameplay videos

• Revealing the ending of the original game

• Reusing derivative works without permission from the original creator

• Any other conduct that is deemed to be extremely inappropriate according to social standards, such as excessive sexual expression or content that slanders a specific individual, group, or race.

Additionally, modifying or publishing the artist's photographs without the artist's permission is not permitted.

Regarding the scope of fan activities

You may freely create, distribute, and distribute derivative works (illustrations, manga, novels, scenarios, figurines, dolls, other three-dimensional objects, doujinshi, doujinshi goods, digital works, etc.) based on "Hypnosisoft's original series, etc.") without obtaining individual permission, as long as they do not fall under the "Prohibitions in Derivative Creation Activities" listed below.
Please note that this only applies to individuals, unincorporated organizations, and others for "non-profit purposes" as defined below.

If you wish to engage in derivative works as a company or organization with legal status, or if you wish to engage in derivative works that go beyond the criteria of these guidelines, please contact us.

■ Criteria for determining whether something is non-profit or for-profit

The criteria for determining non-profitability are as follows:
"When using it for hobby purposes or when you receive compensation or profit equivalent to the cost of production such as raw materials and tools, it is considered to be within the scope of non-profit purposes."

■ Examples of non-profit uses that can be made by individuals or unincorporated organizations

• Creating, displaying, or distributing fanzines within a distribution channel where HypnosisSoft original works are sold or licensed

• Creating, displaying and distributing cosplay costumes

• Holding a real-life event themed on "Hypnosisoft's original series Hyakki Gensouki series, etc."

• Use of the "Touhou Fantasy Eclipse" soundtrack in a real-life event themed around "Hypnosisoft's original series Hyakki Gensoki"

• Creation, display and distribution of illustrations, figures, dolls and other three-dimensional works

• Distribution, exhibition, screening, and publication on websites of cosplay photos and videos

• Arrange or perform music from the Hypnosisoft original series (such as the Hyakki Gensouki series)

Distribution of derivative works may only be done through distributors that sell the original work or that allow such distribution.

• Examples include doujinshi sales events, doujin shops (in-store and online), events and distribution with individual permission, in-house mail order (limited to products produced as packages), e-book sales, music download sales through various doujin music distribution services, download stores where original games are sold, paid events held as part of group activities, indie game sites, etc.

Browser-based game apps and smartphone game apps must be free. The inclusion of advertisements within the app and the in-app purchase feature to disable advertisements are OK.

Distributing derivative videos (including gameplay videos of the original work) via video distribution services.

If you have received permission for any other content, please indicate so.

As for crowdfunding, as a publisher we cannot take responsibility for any issues that may arise from fundraising that goes beyond the scope of personal activity, so please refrain from using it.
If you absolutely must carry it out, please do not do so without permission and contact us individually.
